Terms of Use

1. These Terms

1.1 These Terms of Use ("Terms") are a contract between you and Clique Connection Co., Ltd. (Công ty TNHH Clique Connection, tax code 0318630204, 130/4 Đường Cách Mạng Tháng 8, Phường Nhiêu Lộc, Thành phố Hồ Chí Minh, Việt Nam) ("Clique83", "we", "us"). They cover the Clique83 Connection app and everything you do in it ("the app").

1.2 You accept these Terms by ticking the box when you create your account. That tick is your electronic signature under Vietnam's Law on Electronic Transactions (Law No. 20/2023/QH15). If you do not agree, do not create an account.

1.3 Two other documents form part of these Terms: the Privacy Notice, which explains how we handle your data, and the Community Guidelines. The app's own rules pages (for example, the cancellation rules in Hỏi đáp) form part of them too.

1.4 The Agency Policy & Terms at clique83.com/en/agency-policy apply only to our separately sold, in-person matchmaking service. They do not apply to the app. Thử Vị Yêu events have their own ticket terms.

1.5 These Terms are in Vietnamese and English. If the two differ, the Vietnamese version prevails.

2. What the app is, and what it is not

2.1 The app introduces members to each other one at a time by letter. When both say yes, it arranges a first date at a café or other venue. Members cannot message each other in the app.

2.2 We do not promise any result. We do not promise that you will be introduced to anyone, how many introductions you will get, or how soon. We do not promise that someone will say yes, that a date will happen, or that you will like the person, feel chemistry, start a relationship or marry. Fees pay for our work in choosing, introducing, arranging and booking, not for any outcome.

2.3 What you tell us about the person you want to meet is a wish we take into account, not a filter we guarantee. We decide who to introduce to whom, using our own judgement and methods, which we may change.

2.4 Clique83 is not a marriage brokerage service and does not arrange marriages, including marriages with foreigners. It is not a social network: members do not publish content to each other and cannot chat.

2.5 We are not a party to your date. We do not run the café or venue and are not responsible for its food, drinks, service, prices or premises.

3. Who can be a member

3.1 To use the app you must, at sign-up and the whole time you are a member:

1. be at least 21 years old;
2. not be married. If you are separated but not yet divorced, you must say so in your profile, and the people introduced to you will see it;
3. not have been convicted of a violent or sexual offence, or be subject to a court order to stay away from someone;
4. not have had an account closed by us before, unless we agree in writing;
5. have full legal capacity to enter this contract;
6. use the app only for yourself, to meet people for a relationship or friendship, and not for any business.

3.2 You confirm all of this by ticking the box at sign-up. If any of it is untrue or stops being true, we may close your account at once under section 13.

4. Your account

4.1 Everything you tell us must be true, current and about you. Your photos must be recent, clearly show you, and show no one else as if they were you. Keep your profile up to date, especially your relationship status.

4.2 You may have one account. It is personal: you may not share it, sell it, or let anyone else use it.

4.3 Keep your password secret. You are responsible for everything done through your account until you tell us it has been misused. Tell us at once at connect@clique83.com if you think it has.

4.4 We may check any information you give us, ask you for proof, and refuse or pause an account until we are satisfied. Every photo is checked by a person on our team (see the Privacy Notice). Passing a check does not mean we vouch for you to other members.

5. Membership, the trial and subscriptions

5.1 To arrange dates you need a membership. The membership is an auto-renewing subscription of 6 months or 1 year, bought through the App Store or Google Play ("the store"). The price and what it includes are shown before you buy.

5.2 It renews automatically at the end of each period, at the price then shown, unless you turn off auto-renewal in your store account settings at least 24 hours before the period ends. The store charges your store account. Cancelling stops the next renewal. You keep the membership until the end of the period you have paid for.

5.3 Deleting your account, being frozen, or not using the app does not cancel or pause your subscription. Only you can cancel it, in the store settings.

5.4 If the price changes, the store tells you before it applies, under the store's own rules. A price change never affects a period you have already paid for.

5.5 The trial. We may offer some new members a free trial, currently 30 days for men. The trial is given by Clique83, not the store. It needs no card and does not turn into a paid membership by itself. It starts once your six photos are complete. During it you can receive and read letters. To arrange a date you need to become a member. One trial per person. We may change or end trial offers for new members at any time. Offers may differ between groups of members, to keep introductions balanced.

6. Date fees, packs and the Ví Buổi Hẹn

6.1 Each date you arrange costs a date fee, or one date from your Ví Buổi Hẹn (Date wallet). You can buy dates one at a time or in packs. Prices are shown before you pay. The date fee covers choosing the introduction, arranging the date and booking the table. It does not cover what you eat or drink at the café, which you pay yourselves.

6.2 Treating her. A member may pay the other person's date fee. If they had already paid, their date comes back to their own Ví Buổi Hẹn. If the date does not go ahead, the treated date comes back to the Ví Buổi Hẹn of the member who paid. The person treated is told they were invited, but never the price.

6.3 The Ví Buổi Hẹn holds dates, not money. A date in it ("1 Buổi Hẹn") can be used for one date in the app. It has no cash value. It cannot be exchanged for cash, withdrawn, sold or given to another account, except by treating someone as in 6.2. It does not expire while your account is open.

6.4 When you delete your account, the dates in your Ví Buổi Hẹn are lost once the 30-day restore period ends. The app tells you how many you will lose before you confirm. They are also lost if we close your account for a breach of these Terms.

7. Refunds

7.1 Store purchases. Memberships, date fees and packs are bought through the store, and only the store can refund them, under its own refund policy. We cannot issue or block a store refund. To ask for one, use Apple's request page or Google Play's refund page.

7.2 What Clique83 gives back. In the cases below, the date you used comes back to your Ví Buổi Hẹn as 1 Buổi Hẹn. It never comes back as cash:

1. the other person cancels or moves the date and you do not accept the new time;
2. the other person does not come, and our team confirms it;
3. our team accepts your emergency (see 8.6);
4. no shared time or café can be found within the app's time limits, and neither of you let the time limit run out;
5. you block the other person for a serious safety reason while a date is booked, once our team has reviewed your report;
6. we cancel the date ourselves for a reason that is not your fault.

7.3 Apart from 7.1 and 7.2, fees are non-refundable. This includes when you didn't like the person, felt no chemistry, changed your mind, cancelled, did not come, were frozen, or had your account closed for a breach.

7.4 Chargebacks. You may dispute a charge with the store or your bank. While a dispute is open we may pause your account. If the dispute succeeds, we may remove whatever that payment bought, including dates in your Ví Buổi Hẹn and membership time, and we may refuse further purchases if the dispute was not in good faith.

7.5 Nothing in this section limits a right to a refund that Vietnamese law gives you and that cannot be waived.

8. Arranging, moving and cancelling dates

8.1 A date is made when both people say yes to the letter, both confirm the date fee, both give free times, a shared time is found, and the café is chosen. Each step has a time limit shown in the app. If you let a time limit run out, it counts as you cancelling.

8.2 Tables are booked under the name "Clique83". If the venue cannot hold the table, the app asks for another venue, or Clique83 chooses one.

8.3 One free move. You may move a confirmed date once, for free, until 24 hours before it starts. The new time goes to the other person to accept. If they decline, the date is cancelled and nobody loses their fee. Within 24 hours, or after the free move is used, moving counts as cancelling.

8.4 Cancelling. If you cancel a confirmed date for any reason other than an accepted emergency, you lose that date's fee (or the date from your Ví Buổi Hẹn). The other person gets their date back and is never told your reason.

8.5 Every cancellation counts, for 3 months. That includes a cancellation, a time limit you let run out, a confirmed no-show, a declined emergency, a block given with no reason while a date is booked, and deleting your account while a date is booked. Three months with no cancellation resets your count. The steps:

The app shows where you stand every time you cancel, and asks you to confirm you understand.

8.6 Emergencies. If you must cancel because of illness, a family emergency or an accident, tell us in the app and attach proof if you can. Our team decides, at its reasonable discretion, whether to accept it. If accepted, you get the date back and the cancellation does not count. If not, it counts as a cancellation.

8.7 No-shows. If the other person has not arrived 20 minutes after the start and has not told you, report it in the app. We ask them for their side (they have 24 hours) and may check with the café. If our team confirms the no-show, their account is frozen for 7 days and it counts as a cancellation. If a step in 8.5 calls for a longer freeze, the longer one applies; freezes are never added together.

8.8 While frozen you get no new letters, you appear in no one's letters, and you cannot arrange a new date. Your profile, Ví Buổi Hẹn and past dates stay open. Dates already confirmed still go ahead, and cancelling one counts. Your membership or trial time keeps running while you are frozen. Nobody else is told.

8.9 Appeals. You can appeal a freeze, a no-show decision or a declined emergency by email from the app. The freeze stays while we look. If we accept the appeal, the account reopens at once and that cancellation no longer counts.

9. Your safety

9.1 We do not run criminal record, identity-document or background checks on members. Our checks are limited to what we describe in 4.4. We cannot guarantee that what any member tells you or us is true, or how any member will behave.

9.2 You are responsible for your own safety, before, during and after a date. Meet only at the booked venue. Arrange your own transport. Tell a friend where you are (Share my date helps). Never send money or give financial details to a member, and report anyone who asks.

9.3 If you are in danger, call 113 (police) or 115 (ambulance) first, then call or message (Zalo) the Clique83 hotline at 0348814483.

9.4 You can report or block a member at any time (section 12). We may share information with the police or other authorities when the law requires it, or when we believe someone's life or safety is at risk.

10. What you put in the app

10.1 Your photos, answers and texts stay yours. You give us a non-exclusive, royalty-free licence, valid worldwide for as long as your data is kept, to store, check, copy, resize, translate and show them inside the app. We use them only to run the app, keep it safe and meet legal duties. We never use your photos or texts in advertising or on social media without asking you separately.

10.2 You confirm that you have the right to everything you upload, that it shows you, and that it breaks no law or anyone's rights (including another person's image).

10.3 We may refuse, hide or remove anything that breaks these Terms or the Community Guidelines, without notice where safety requires.

11. Rules of behaviour

You must follow the Community Guidelines. In particular, you must not:

1. lie about who you are, your age, your relationship status, or use someone else's photos;
2. harass, threaten, pressure, insult or discriminate against anyone, or touch anyone without consent;
3. ask for or offer money, gifts, investments, loans, cryptocurrency, or sexual services, or sell anything to a member;
4. record, photograph or film another member without their consent, or share their name, photos, letter or details outside the app (except Share my date as designed);
5. use an introduction to arrange the first date outside the app to avoid the date fee;
6. create more than one account, or a new account to get round a freeze or a closed account;
7. copy, scrape, reverse engineer or interfere with the app, use bots, or try to reach data that is not yours;
8. use the app for anything illegal under Vietnamese law.

12. Reports, blocks and our decisions

12.1 You can block a member from their letter or from a booked date, and report them from the letter, after a date, or by email. A report is private: the member is never told who reported or what was said.

12.2 We read every report. The most serious are handled first, and we do not promise a fixed reply time. While we look into a serious report, we may pause the reported member's letters. We decide, at our reasonable discretion and on the information we have, what action to take: a reminder, a freeze, closing the account, or nothing. We tell the person who reported that we acted, never what we did.

12.3 Two members who block or report each other are never introduced again (unless a block is removed).

13. Suspending and closing accounts

13.1 We may pause, freeze or close your account, and remove you from introductions, if:

1. you break these Terms or the Community Guidelines;
2. we reasonably believe you are a risk to another member or to Clique83;
3. you give us false information or fail a check;
4. a payment is disputed or reversed (7.4);
5. the law or an authority requires it.

13.2 We will tell you why, unless the law forbids it or telling you would put someone at risk. You can appeal by email.

13.3 If your account is closed for one of the reasons above, you lose your membership time and the dates in your Ví Buổi Hẹn, and we owe you no refund, to the extent the law allows. A store refund remains the store's decision.

13.4 If we stop the app or close your account for a reason that is not your fault, we will turn the value of the dates left in your Ví Buổi Hẹn, at the price you paid, into credit for another Clique83 service, such as a Thử Vị Yêu event.

14. Deleting your account

14.1 You can delete your account at any time in Cài đặt › Xoá tài khoản. From that moment you get no new letters, appear in no letters, and your open invitations are withdrawn. A booked date is cancelled and counts under 8.5.

14.2 For 30 days you can sign in again to restore your account (a cancelled date stays cancelled). After 30 days your data is erased as the Privacy Notice explains, and the dates in your Ví Buổi Hẹn are lost (6.4).

14.3 Deleting does not cancel your store subscription (5.3).

15. Changes

15.1 We may change, add or remove features of the app, to improve it, keep it safe or meet the law.

15.2 We may change these Terms. For a change that affects your rights or what you pay, we will show you the new Terms in the app at least 15 days before they apply, and ask you to agree. If you do not agree, you may delete your account before the change applies. A change never affects a purchase already made.

16. What we do not guarantee

16.1 We work hard to keep the app running and accurate, but we provide it "as is". We do not guarantee that it will always be available or free of errors, or that other members' information is true.

16.2 We are not responsible for the behaviour of members, whether in the app, at a date or afterwards, nor for cafés, the stores, phone networks or other services we do not control.

17. Limits on our liability

17.1 To the extent the law allows, our total liability to you for all claims connected with the app is limited to the amount you paid Clique83, through the store or otherwise, in the 6 months before the event that caused the claim.

17.2 To the extent the law allows, we are not liable for indirect or consequential loss, lost profits or opportunities, emotional distress, or loss caused by another member, a café or any third party.

17.3 Nothing in these Terms limits our liability for death or personal injury caused by our own fault, for fraud, or for anything else Vietnamese law does not allow us to exclude, including your rights under the Law on Protection of Consumer Rights (Law No. 19/2023/QH15).

18. Your responsibility to us

You agree to compensate Clique83, its staff and partners for losses, claims and reasonable costs (including legal fees) that result from your breach of these Terms, your content, or your behaviour towards another member or any other person, to the extent the law allows.

19. Apple and Google

19.1 If you downloaded the app from the App Store: these Terms are between you and Clique83, not Apple. Apple is not responsible for the app, its content, maintenance or support. If the app fails to meet any warranty that applies by law, you may tell Apple, and Apple may refund the purchase price of the app; Apple has no other warranty obligation. Apple is not responsible for any claim about the app, including product liability, failure to meet legal requirements, consumer protection, privacy or intellectual property claims; Clique83 is. You confirm that you are not in a country under a United States government embargo or on a United States list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

19.2 If you downloaded the app from Google Play, Google Play's terms of service also apply to your purchases, and Google is not responsible for the app.

20. Our rights in the app

The app, its design, the letters' format and texts, the names Clique83, Clique83 Connection and Thử Vị Yêu, and our logos belong to us. We give you a personal, non-transferable, revocable licence to use the app on your own device for its intended purpose while you are a member. Nothing else is licensed.

21. How we contact each other

We contact you in the app, by notification or by email. Notices sent this way count as received when sent. You contact us at connect@clique83.com, or through the hotline 0348814483 (call or Zalo) for emergencies during a date.

22. Law and disputes

22.1 These Terms are governed by the law of Vietnam.

22.2 If you have a complaint, write to connect@clique83.com first. We will try to settle it with you within 30 days.

22.3 If that fails, either of us may go to mediation, or to arbitration if both agree in writing after the dispute has arisen, or to the competent court in Vietnam. Where the law lets the parties choose, that is the court in Ho Chi Minh City. Nothing here takes away a right the Law on Protection of Consumer Rights (Article 67) gives you to choose how to resolve a dispute.

23. General

23.1 These Terms, the Privacy Notice and the Community Guidelines are the whole agreement about the app.

23.2 If a court finds part of these Terms invalid, the rest still applies, and the invalid part is replaced by the nearest valid wording.

23.3 If we do not enforce a right at once, we have not given it up.

23.4 We may transfer this contract to a company that takes over the app, and we will tell you. You may not transfer it.

23.5 We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, epidemics, outages of the stores or networks, or orders from authorities.
